मनुष्य जन्म से निर्दोष होता है। यदि समाज ही उसे गलत बनाता है, तो केवल व्यक्ति को ही दंड क्यों दिया जाता है? मानव मनोविज्ञान स्वाभाविक रूप से व्यक्ति को गलत दिशा की ओर आकर्षित करता है। किसी व्यक्ति की मासूमियत को उचित परवरिश और करुणामय शिक्षा के माध्यम से सुरक्षित रखा जा सकता है, और यही उसका पहला तथा सबसे मौलिक अधिकार है। गलत कार्यों की जिम्मेदारी उस व्यक्ति पर नहीं आती जो जन्म से निर्दोष होता है, बल्कि उसके परिवार और समाज पर आती है। इसलिए दंड देने के बजाय करुणामय शिक्षा पर आधारित परवरिश तथा पुनर्वास केंद्रों (Rehabilitation Centers) के माध्यम से उसकी मासूमियत को पुनः स्थापित करने पर ध्यान दिया जाना चाहिए। इस वास्तविकता को ध्यान में रखते हुए दुनिया भर की कानूनी व्यवस्थाओं में सुधार किया जाना चाहिए और इस दृष्टिकोण को प्रत्येक शैक्षणिक संस्थान तथा विधि महाविद्यालय (Law School) के पाठ्यक्रम का हिस्सा बनाया जाना चाहिए। जिस प्रकार जब हम कोई मशीन बनाते हैं और वह लोगों को गंभीर नुकसान पहुँचाती है, तो हम मशीन को दोषी नहीं ठहराते। हम उस टीम को जिम्मेदार मानते हैं जिसने उसे बनाया और डिज़ाइन किया,...
